Welcome to HBG Health. These Terms & Conditions (“Terms”) govern your use of our website and the purchase of products and services from HBG Health (“Company,” “we,” “us,” or “our”). By accessing our website or placing an order, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use this website or purchase our products.

1. Medical Disclaimer

HBG Health does not provide medical advice.

  • All information on this website is for informational purposes only

  • Products and services are provided based on prescriptions, physician orders, or customer selection

  • Always consult your physician or licensed healthcare provider regarding diagnosis, treatment, or medical decisions

Use of our products is at your own risk and subject to the guidance of your healthcare provider.

2. Prescription Requirement

Certain products sold by HBG Health require a valid prescription.

  • Orders for prescription-required items will not be processed until appropriate documentation is received

  • HBG Health reserves the right to cancel and refund any order if a valid prescription is not provided

3. Insurance Billing & Patient Responsibility

Insurance coverage is not guaranteed.

By submitting insurance information, you acknowledge and agree that:

  • Insurance claims may be denied or partially paid

  • You are financially responsible for deductibles, copayments, coinsurance, non-covered items, and denied claims

  • Rental and purchase determinations are subject to payer guidelines

  • Medicare, Medicaid, and commercial insurance rules apply

HBG Health is not responsible for coverage decisions made by insurance providers.

4. Orders, Pricing & Payment

  • All prices are subject to change without notice

  • Orders are subject to availability and acceptance

  • We reserve the right to refuse or cancel any order at our discretion

  • Payment must be received prior to shipment unless otherwise agreed in writing

5. Returns & Exchanges

All returns are governed by our Returns & Exchanges Policy, which is incorporated into these Terms by reference.

  • Medical devices and insurance-billed items are subject to strict return limitations

  • Unauthorized returns will be refused

  • Custom kits and private-label products are non-returnable

6. Shipping & Risk of Loss

  • Shipping timelines are estimates and not guaranteed

  • Risk of loss passes to the customer upon delivery to the carrier

  • HBG Health is not responsible for delays caused by carriers or events beyond our control

7. Manufacturer Warranties

  • Products may carry manufacturer warranties

  • HBG Health does not modify or extend manufacturer warranties

  • Warranty claims are subject to manufacturer terms and processes

8. Limitation of Liability

To the maximum extent permitted by law:

  • HBG Health shall not be liable for indirect, incidental, consequential, or special damages

  • Liability is limited to the amount paid for the product giving rise to the claim

This includes, but is not limited to, loss of profits, loss of use, or personal injury resulting from misuse or failure to follow medical guidance.

9. Indemnification

You agree to indemnify and hold harmless HBG Health, its owners, employees, and affiliates from any claims, damages, losses, or expenses arising from:

  • Misuse of products

  • Failure to follow medical instructions

  • Violation of these Terms

10. Business-to-Business (B2B) Customers

B2B transactions may be governed by separate agreements, pricing, minimum order quantities, and return terms.

In the event of a conflict, the written B2B agreement shall control.

11. Privacy

Use of this website is also governed by our Privacy Policy, which describes how personal and health-related information is handled.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles.

13. Modifications

HBG Health reserves the right to update or modify these Terms at any time without prior notice. Continued use of the website constitutes acceptance of the updated Terms.

Returns Policy

  • Consumer Returns

    1.1 Retail (Non-Prescription, Cash-Pay Items)

    Eligible Returns

    - Items must be unopened, unused, and in original packaging

    - Return request must be made within 14 days of delivery

    - Proof of purchase is required

    Non-Returnable Items

    - Opened or used medical devices

    - Consumable products (including but not limited to mask cushions, filters, tubing, wipes, and hygiene-related items)

    - Clearance or final-sale items

    Refunds

    - Approved refunds will be issued to the original form of payment

    - Original shipping charges are non-refundable

    Return Shipping

    - Customers are responsible for return shipping costs unless the item is defective or shipped in error

    1.2 Prescription & CPAP Equipment (Cash Pay)

    Due to FDA, hygiene, and safety regulations, prescription medical equipment is subject to strict return limitations.

    CPAP Machines

    - CPAP machines may be returned only if unopened and unused

    - Opened, powered-on, or used CPAP machines are non-returnable

    Masks & Accessories

    - Masks, tubing, humidifier chambers, cushions, and accessories are non-returnable once opened

    - Manufacturer warranties apply in cases of defects

    Exchanges

    - One-time mask exchange for sizing issues may be permitted within 7 days of delivery

    - Exchanges are subject to product availability

    - Customer is responsible for return shipping

    1.3 Insurance-Billed Orders (Medicare, Medicaid, and Commercial Insurance)

    Items billed to insurance are governed by payer regulations and cannot be returned for convenience.

    - Insurance-billed items are non-returnable and non-refundable once dispensed

    Returns are permitted only in cases of:

    - Documented therapy discontinuation

    - Manufacturer defect

    - Insurance-approved circumstances

    - Physician documentation may be required

    - Patients remain responsible for any non-covered or denied charges

  • Business-to-Business

    2.2 Standard B2B Orders

    Return Eligibility

    - Return requests must be submitted within 10 days of delivery

    Products must be unopened, unused, and in resalable condition

    Restocking Fee

    - Approved returns are subject to a 20% restocking fee

    Shipping

    - All return shipping costs are the responsibility of the buyer

    Non-Returnable Items

    - Clearance or discounted bulk orders

    - Special-order items

    2.2 Custom Kits & Private-Label Products

    Custom-assembled kits and private-label products are built to order and cannot be restocked.

    - Custom kits and private-label products are non-returnable and non-refundable

    - Claims for incorrect or damaged items must be reported within 48 hours of delivery

    - HBG Health will determine the appropriate resolution, including replacement or credit

    3.1 Damaged, Incorrect, or Defective Items

    All customers must notify HBG Health within 48 hours of delivery if an item is damaged, defective, or incorrect.

    4.1 Return Authorization (RMA)

    All returns require prior authorization.

    - Returns sent without an approved Return Merchandise Authorization (RMA) will be refused

    - Unauthorized returns will be returned to sender at the sender’s expense
